GNC as you may know (see news update on page 15) reached an agreement with the attorney general s office in late March whereby the company will use DNA tests to authenticate the plants that will be used as ingredients in its herbal supplements. Some industry experts applauded the agreement while others said it set a dangerous precedent going forward. Of course the questionable DNA testing methods used have come under harsh scrutiny by the likes of the Natural Products Association (NPA) the Council for Responsible Nutrition (CRN) and other industry groups but that didn t prevent Schneiderman and 13 other state attorneys general from sending a letter to Congress requesting an investigation into herbal supplements and calling for more regulatory oversight of the industry by the Food and Drug Administration (FDA). Schneiderman and his counterparts despite admitting that the federal good manufacturing practices currently in place for dietary supplements are sufficient continues to push forward in what is seemingly becoming a witch hunt at the expense of taxpayer dollars. 1994 ea t ng 20 Y CelebraEixcellence f o rs 2014 J While the two sides continue to slug it out and the NPA calling for a grassroots campaign to attempt to prevent Schneiderman from taking further action a larger question for the industry at-large may be Has the damage already been done While little has yet to be determined legally regarding the outcome of the dispute the danger here for the dietary supplement industry is that in the court of public opinion they may have already lost. Of course a Harvard-led study early last month that indicated that a handful of weight-loss and sports supplements contained amphetamine-like ingredients not the plant extract listed on the label of the product didn t help the cause. For those who have long supported the dietary supplement industry not much will change. Natural products manufacturers suppliers and retailers alike will strongly defend the methods used to test and regulate their industry and will continue to fight for its survival. On the other hand those who have long opposed or questioned the industry now have more ammunition at their disposal to challenge every move the industry makes. And finally the real danger here is in convincing those consumers who have long been considering walking into your store to try a natural remedy or supplement might now be turned off by the ongoing negative press. So what s the next step Will the letter to Congress sent by Schneiderman and the 13 other state attorneys general be enough to eventually push the industry under regulation by the federal government Does DSHEA carry no weight here For now the smart move for the dietary supplement industry is to continue to provide the quality products that it s always provided. I also encourage you to take part in NPA s grassroots campaign and to join in fighting the good fight. Industry Associations Comment on BMPEA Actions he Natural Products Association (NPA) CEO and Executive Director Daniel Fabricant PhD commented on Sen. Chuck Schumer s (D-N.Y.) call for the FDA to ban any product containing BMPEA a substance similar to amphetamine after reports that the ingredient was found in dietary supplements. The Natural Products Association strongly believes that banning products containing BMPEA is an unrealistic way for the FDA to remove them from store shelves and is a waste of the agency s time and resources Fabricant stated. The proposed ban is not based in the reality of how food and drug law actually works. The agency has several stronger and quicker tools it can rely on to go after products that it feels pose a threat to consumers including mandatory recall authority and administrative detention. What s more the FDA has the necessary expertise on staff to determine whether BMPEA is dangerous and if and how it should be removed from the marketplace. While many have questioned whether BMPEA is a legitimate dietary ingredient that decision is ultimately up to the FDA and the agency can use its power to take action against companies that have not filed new dietary ingredient notifications (NDIs). The FDA has T always had full regulatory authority over dietary supplements and protecting public health is at the forefront of its mission. NPA supports FDA exercising its full regulatory authority under the law if it finds valid safety concerns with certain products. The Council for Responsible Nutrition (CRN) also issued a statement by Steve Mister president & CEO in response to an article An amphetamine isomer whose efficacy and safety in humans has never been studied methylphenylethylamine (BMPEA) is found in multiple dietary supplements published online in Drug Testing and Analysis. We share the concerns of Dr. Pieter Cohen and his study co-authors regarding BMPEA an amphetamine isomer stimulant that should not be used in dietary supplement products because it is a synthetic drug-like substance not a dietary ingredient Mister stated. The Food and Drug Administration (FDA) first raised the issue of Acacia rigidula supplements adulterated with BMPEA in an article published by the agency in 2014 in the Journal of Pharmaceutical and Biomedical Analysis noting that the amine compound is not found in the Acacia rigidula plant. We urge FDA to take immediate enforcement action against these adulterated products containing BMPEA and the companies illegally spiking these products with this synthetic drug Mister continued. BMPEA does not appear to be a legitimate dietary ingredient and therefore its inclusion in a product labeled as a dietary supplement makes the product adulterated under the Dietary Supplement Health & Education Act (DSHEA). Under the law the agency can demand a product recall for potential safety concerns. It can also declare these products misbranded because synthetic BMPEA was not listed on the labels or proclaim they are adulterated for the simple fact that there has been no pre-market notification submitted for BMPEA as required by law... Although Acacia rigidula supplements represent a very small portion of the dietary supplement industry--so small that we are not aware of specific sales data--FDA has the tools it needs under the law to take action before there are serious health consequences and CRN is asking the agency to do just that. In its response to the NYAG s inquiry GNC provided the results of rigorous tests conducted both internally and by independent third parties. These tests provided conclusive evidence that GNC s products are safe pure properly labeled and in full compliance with all regulatory requirements. The testing also demonstrated that the company s products contain all herbal extracts listed on their respective labels. In addition a former senior FDA cGMP expert performed a comprehensive review of GNC s manufacturing processes for the products at issue and found them to be in compliance with all applicable requirements. Accordingly GNC has O restored its full assortment of Herbal Plus products to all GNC stores in New York State. GNC also announced that it will expand its testing processes deeper into its supply chain by leading ongoing industry efforts to integrate source material traceability standards including DNA barcoding where appropriate (prior to extraction processes) and enhance certain other aspects of its operations to provide consumers even greater confidence in its products. GNC said that it believes these measures which would not have impacted availability of the products subject to this review will result in the adoption of stricter minimum standards across the broader industry. The presentation was part of a panel discussion that examined the A implications of several possible regulatory schemes for cannabis products. McGuffin provided an overview of many aspects of federal regulations for supplements including mandatory manufacturing facility registration allowed ingredients in dietary supplements the forms of dietary supplements NDIs (new dietary ingredients) labeling requirements and advertising claims and current good manufacturing practice (cGMP) requirements. McGuffin also reviewed six warning letters the Food and Drug Administration (FDA) recently sent to companies marketing products with the ingredient cannabidiol (CBD). A further reduction to below 5 percent or roughly 25 grams (6 teaspoons) daily would provide additional health benefits the WHO said. Free sugars refer to monosaccharides (such as glucose fructose) and disaccharides (such as sucrose or table sugar) added to foods and drinks by the manufacturer cook or consumer and sugars naturally present in honey syrups fruit juices and fruit juice concentrates. According to Dr. Francesco Branca director of WHO s Department of Nutrition for Health and Development Making policy changes to support this will be key if countries are to live up to their commitments to reduce the burden of non-communicable A diseases. Australia s Obesity Policy Coalition said that the release of the WHO s guidelines around sugar has prompted a coalition of leading health organizations to call for a national strategy around obesity that includes policies to directly impact the amount of added sugars. The Natural Products Association (NPA) has heard from many retailers that customers are inquiring about the attorney general s investigation and what it means for the products they rely on each day to benefit their health and wellness. NPA has put together helpful talking points to share with your customers to better educate them on this issue and make them aware that their supplements have always been and will continue to be safe and effective. go unchecked the way in which you buy goods in this country could be significantly impacted. Do you want your choices as a consumer to be curtailed in this manner If the answer is no then you must take action now. Q Is there something wrong with herbal supplements based upon the NYAG s findings No. The NYAG s argument is based on flawed science and application of a method that is not fitfor-purpose. There s no evidence to suggest that these products are harmful or non-compliant with federal laws. All of the botanical dietary ingredients that are the subject of the NYAG s investigation have a long history of use and a strong library of research data supporting their health benefits. Dietary supplement regulations are also in place to ensure the products are manufactured to high quality regarding their composition strength identity and purity and are free of contaminants. Dietary supplements are the only commodity of foods that has a 100 percent mandatory requirement for reporting serious adverse event reports (AERs) to the U.S. Food and Drug Administration (FDA). The agency monitors every single AER for safety issues and uses the reports to remove supplements found to be unsafe from store shelves request a voluntary recall force a mandatory recall or seize products found to be non-compliant with federal laws. Q Are dietary supplements regulated and who regulates them For more than 20 years the FDA has had full regulatory authority and oversight of dietary supplement quality safety and labeling. The Dietary Supplement Health and Education Act of 1994 authorized the FDA to issue regulations to cover all aspects of supplement manufacturing. State attorneys general on the other hand do not have the authority to pull supplements from shelves whereas the FDA is fully equipped to go after dietary supplement manufacturers who do not play by the rules. Since that is not the case here the FDA has not pursued action against any of the manufacturers in question. Q How can this affect you and your dietary supplements The actions and misinformation started by the NYAG has already spread to other states including the attorneys general in Indiana Connecticut the District of Columbia Hawaii Idaho Iowa Kentucky Massachusetts Mississippi New Hampshire Pennsylvania Rhode Island and the Northern Mariana Islands. The attorneys general from these states recently sent a letter to Congress asking them to investigate the supplement industry and expand the FDA s regulatory authority over supplements. Allowing state attorneys general to pull products off shelves without proper regulatory authority sets a dangerous precedent which is a threat across all industries and significantly impacts consumer choice. Q What can you do Consumers must become active in the Natural Products Association s grassroots efforts and prevent officials from removing products especially without sharing the scientific basis for those requests. But even this has not stopped the NYAG from moving forward with his investigation including sending a letter to Congress requesting it devote time and taxpayer dollars to the matter or releasing his study data which would help better understand exactly what was studied and how. Zinc deficiency could play a role in chronic diseases such as cardiovascular disease cancer and diabetes that involve inflammation. Such diseases often show up in older adults who are more at risk for zinc deficiency. When you take away zinc the cells that control inflammation appear to activate and respond differently this causes the cells to promote more inflammation said Emily Ho a professor and director of the Moore Family Center for Whole Grain Foods Nutrition and Preventive Health in the OSU College of Public Health and Human Sciences and lead author of the study. Approximately 12 percent of people in the U.S. do not consume enough zinc in their diets. Of those 65 and older closer to 40 percent do not consume enough zinc Ho said. Older adults tend Z to eat fewer zinc-rich foods and their bodies do not appear to use or absorb zinc as well making them highly susceptible to zinc deficiency. It s a double-whammy for older individuals said Ho who also is a principal investigator with the Linus Pauling Institute. In the study researchers set out to better understand the relationship between zinc deficiency and inflammation. They conducted experiments that indicated zinc deficiency induced an increase in inflammatory response in cells. The researchers were able to show for the first time that reducing zinc caused improper immune cell activation and dysregulation of a cytokine IL-6 a protein that affects inflammation in the cell Ho said. Researchers also compared zinc levels in living mice young and old. The older mice had low zinc levels that correspond- ed with increased chronic inflammation and decreased IL-6 methylation which is an epigenetic mechanism that cells use to control gene expression. Decreased IL-6 methylation also was found in human immune cells from elderly people Ho said. Together the studies suggest a potential link between zinc deficiency and increased inflammation that can occur with age she said. We think zinc deficiency is probably a bigger problem than most people realize she said. Preventing that deficiency is important. Understanding why older adults do not take in zinc as well is an important area for future research Ho said. Vitamin D Helps Immune Cells Prevent Atherosclerosis Diabetes A ltered signaling through the vitamin D receptor on certain immune cells may play a role in causing the chronic inflammation that leads to cardiometabolic disease the combination of type 2 diabetes and heart disease that is the most common cause of illness and death in Western populations. The research appears in the journal Cell Reports. Because low vitamin D levels are associated with diabetes and heart disease we looked at the connections between vitamin D immune function and these disease states said Senior Author Carlos BernalMizrachi of the Washington University School of Medicine in St. Louis MO. The investigators found that when they engineered mice to lack expression of the vitamin D receptor in immune cells called monocytes and macrophages the animals accumulated atherosclerotic plaques in their blood vessels and developed insulin resistance meaning that their liver cells had a diminished ability to respond to insulin and regulate blood glucose levels. Inactivation of the macrophage vitamin D receptor promotes inflammation of the liver and of the artery walls. It also increases the ability of blood monocytes to adhere and migrate into the vessel wall where they deposit cholesterol and secrete inflammatory mediators to cause diabetes and heart disease explained Bernal-Mizrachi. This implies that vitamin D will reduce these properties in immune cells to decrease inflammation and reduce the risk of cardiometabolic disease. The research team found that bone marrow transplantation of cells that expressed the vitamin D receptor into mice lacking the vitamin D receptor in monocyte and macrophages improved the animals insulin sensitivity suppressed atherosclerosis and decreased the formation of fat-laden macrophages that accumulate along blood vessel walls. These results suggest that individuals may experience increased inflammation and serious health consequences when their immune cells are exposed to vitamin D deficiency or cannot process vitamin D. Indeed findings from previous studies suggest that individuals with vitamin D deficiency have an increased risk of developing diabetes and that adequate dietary vitamin D in patients with diabetes limits the formation of fat-laden macrophages and decreases atherosclerosis. Our findings provide further mechanistic foundation for multiple interventional trials including our own to evaluate the effects of vitamin D on cardiometabolic disease said Bernal-Mizrachi. In addition the identification of monocyte cholesterol transport as a mechanism for atherosclerosis in our animal model opens up a new area of research that could identify novel therapies for heart disease. And nearly 30 percent of American adults suffer from pre-hypertension a condition that puts them at risk of developing clinical hypertension.2 While pharmaceuticals can bring the pressure down recent studies show that a daily dose of aged garlic extract (AGE) safely and effectively reduces blood pressure and benefits a number of other cardiovascular risk factors. Findings slated to be presented at the 5th Science of Nutrition in Medicine and Healthcare Conference in Australia provide clear evidence that supplementing with AGE can effectively reduce blood pressure levels. In addition AGE has a positive impact on arterial stiffness. The double-blind placebo-controlled study which was conducted at Australia s National Institute of Integrative Medicine divided 88 patients with uncontrolled hypertension into two groups. One group was given 1.2 grams of AGE daily and the other was given a placebo. H Mean blood pressure was significantly reduced by 5.0 2.1 mmHg (p 0.016) systolic and in responders by 11.5 1.9 mmHg systolic and 6.3 1.1 mmHg diastolic compared to placebo (p 0.001). Central hemodynamic measures tended to improve in the garlic group more than in the placebo group including central blood pressure central pulse pressure mean arterial pressure augmentation pressure pulse wave velocity and arterial stiffness. Trends in beneficial effects of garlic on inflammatory marker TNF total cholesterol LDL cholesterol and apolipoproteins were observed. Aged garlic extract was highly tolerable and acceptable and did not increase the risk of bleeding in patients on blood thinning medication. Another study recently presented at the American College of Cardiology s 64th Annual Scientific Session & Expo lends further evidence to Aged Garlic Extract s ability to lower blood pressure. During the study which was conducted at the Harbor-University of California Los Angeles (UCLA) Medical Center four placebo-controlled double-blind randomized studies were pooled to examine AGEs effect on blood pressure. The studies involved a total of 161 people who were randomized to take either 1 000 mg of AGE or a placebo daily for one year. All of the subjects had their blood pressure checked at the beginning and the end of the study. Testing was also done to determine the progression of coronary artery calcification. One year later the UCLA researchers noted marked reductions in diastolic blood pressure among the participants who took AGE. Coronary artery calcification was also significantly lower in those who had taken the AGE supplements. However that is not to say that there are no supplements that can be useful in weight loss and healthy weight maintenance. There are clinically studied ingredients that may make weightloss efforts more successful but they can never compensate for the need to eat a clean healthy diet and increase physical activity. It may surprise you that 20 percent of all meals are eaten in the car and Americans spend more time watching cooking on TV than actually cooking their own meals. In 1992 no state had an obesity rate above 15 percent but just 20 years later in 2012 two out of three states have an obesity rate higher than 25 percent. Much of this can be traced to problems with our food and food choices. Eating a clean healthy diet is not just about counting calories. Many recent studies have shown that food additives preservatives and trace amounts of hor- T mone-disrupting pesticides and herbicides have played a significant role in the epidemic of obesity. Whether it is high fructose corn syrup s (HFCS) altered metabolism increasing fat or aspartame and sucralose sweeteners actually increasing abdominal obesity it is clear that the first step in having a healthier weight is to walk away from Frankenfoods and toward the organic produce aisle. This cannot be a temporary change but a commitment to cleaner eating and an ongoing investment of time and money in quality foods. The list of supplements discussed here to aid weight loss is not in any way all inclusive and there are other natural product avenues that have some level of clinical validation. However here are a few examples of products with current or past popularity in health food retail Iodine Iodine is an essential mineral much in the news regarding the most optimal amount needed for brain function fatigue and cancer prevention. It is the most crucial element for thyroid function. The thyroid gland manufactures thyroid hormone using the amino acid L-tyrosine and the mineral iodine. The thyroid gland sets the rate at which the body burns fuel. It has been likened to a gas pedal in the car and a thermostat in the house. The fuel it burns are calories so higher thyroid function burns more calories even at rest and reduces the likelihood they will become stored energy also known as fat cells. Low thyroid function slows the rate of calorie burning and is associated with weight gain. America is in an iodine crisis as status of iodine has dropped as much as 50 percent in the last few decades while exposure to iodine s competitors (most notably bromide fluoride and chlorine) has greatly increased. Cancer of the thyroid gland has increased 300 percent in the last 30 years and the No. 1 prescribed drug of 2014 in the U.S. was levothyroxine (Synthroid) for hypothyroidism or low thyroid function. Interestingly obesity has shot up to record levels over this same time period. While there is no simple reason for our current obesity epidemic the increasing dysfunction of the thyroid gland could certainly be playing an important role. That means their circulating iodine was just a little more than half the non-obese subjects--a very significant finding. Therefore many integrative practitioners first step in helping individuals develop a healthy weight-loss or weight-maintenance program includes an evaluation of thyroid function that is far more in depth that the TSH levels currently in mainstream medical practice and a trial of therapeutic iodine. Dosage levels vary but many practitioners consider somewhere between 12.5 mg and 30 mg per day a good starting level that can be adjusted up or down as needed. There is also debate on the best form of iodine. Though these soluble fibers can be useful these fibers may be contraindicated in individuals with esophageal strictures or other problems with the esophagus or throat. Because they are so good at absorbing fluids and quickly increasing in size and mass which in very rare cases can become lodged in esophagus. In The Complete Guide to Herbal Medicine authors Charles W. Fetrow and Juan R. Avila cite rare cases in which such blockages had to be surgically removed. However as stated this is extremely rare and should not be a risk for most healthy individuals. Soluble Fiber Fiber has been incorporated into many diet plans for numerous reasons. Foods high in fiber often involve more chewing and subsequently more time for your brain to relay the I m full signal to your stomach. Foods high in fiber also help create a feeling of satiety. White Kidney Bean Extract On average 52 percent of calories consumed by adults are carbohydrates and 55 percent of the caloric consumption of those under the age of 19. There are two types of carbohydrates simple and complex. Sugar is a simple carbohydrate in that it does not need to be broken down to be absorbed. Pasta bread bagels potatoes crackers chips popcorn rice pita oats and many more foods are complex carbohydrates meaning the digestion process must first convert them to simple sugars prior to absorption. A compound called phaseolamin is found in white kidney bean and can combat this conversion. It partially blocks the activity of alpha amylase and since the complex carbohydrate is not converted it is excreted reducing calorie absorption. Multiple studies have shown effectiveness. In one 12-week study the white kidney bean (Phase 2 Carb Controller) group lost seven pounds and the placebo group gained a pound. More than 10 clinical studies show that use of white kidney bean extract for people who regularly consume carbohydrates can assist in weight loss. In clinical trials dosages were 1000--1500 mg daily. Some individuals experience gas bloating and flatus at this dosage level. A novel innovation is a highly purified and concentrated enteric coated white kidney bean with a dosage requirement of only 2 to 4 mg per meal. This is very helpful in controlling blood sugar levels which in turn can trigger appetite. Because the brown seaweed species Green Coffee Bean Extract Researchers have identified a family of chlorogenic acids and other polyphenols in the green (unroasted) coffee bean that play a role in weight loss. Roasting destroys up to 70 percent of these beneficial compounds. A Brazilian study reported in the Journal of Nutrition showed that these compounds are easily absorbed by the body. When it is standardized to contain 40 to 50 percent chlorogenic acid it facilitates calorie burning and lean body mass. The results of another human study published in the journal Phytotherapie it was found that participants using the extract lost almost twice as much of their initial weight compared to the placebo group. In this article I will share other research that demonstrates Garcinia cambogia s value in lowering triglycerides increasing glycogen production and preferentially promoting the use of fat as a fuel source during exercise in favor of carbohydrates. Increasing Glycogen Production This study4 examined the effects of HCA supplementation on glycogen production after a meal in eight healthy exercising male volunteers (average age of 22 years). Also HCA supplementation significantly increased the use of fat as an energy fuel. It should also be noted that the decreased use of carbohydrates as a fuel discussed in the following studies is an indication of glycogen sparing. Background The Garcinia genus consists of 180 species distributed in tropical regions of Asia Africa and Polynesia.1 A few of these species including G. cambogia (also known as Malabar tamarind) contain (-)-hydroxycitric acid (HCA) which has some interesting biological properties.2 The effects of HCA will be the focus of this article. Fat Utilization During Exercise and Increased Time To Exhaustion This study5 investigated the effects of short-term HCA ingestion on endurance exercise performance and fat metabolism in untrained women. Six subjects received 250 mg of HCA or placebo for five days and then participated in cycle ergometer exercise. At a later date the same experiment was performed but those who had previously received the HCA now received the placebo and vice-versa. The results showed that HCA tended to decrease the amount of carbohydrate burned as fuel during one hour of exercise while increasing the amount of fat burned as fuel. In addition subjects using HCA were able to exercise for a longer period of time before reaching exhaustion (p 0.05 see graphs Exercise time to exhaustion). An earlier study6 in men found similar results. Six untrained men received 500 mg HCA or a placebo for five days and then did moderate intensity exercise. Two days later the same experiment was performed but those who had previously received the HCA now received the placebo and vice-versa. The results WWW.VITAMINRETAILER.COM MAY 2015 Lowering triglycerides In 2014 a 60-day study3 analyzed the effect of G. cambogia on the triglycerides (blood fats) in obese women (age 25-60 years). The women divided in treated (n 30) and control (n 13) groups. Those in the treated group received 2 400 mg (800 mg 3 times day) of garcinia extract (50 percent of HCA) and those in the control group received a placebo. Subjects in both groups were also given dietary guidance to reduce their daily caloric intake by 380 calories day. The results showed that triglyceride levels in the treated group were reduced from 132.35 41.61 mg dL to 109.52 38.7 mg dL. That s a decrease of 22.83 62 VITAMIN RETAILER were that blood concentrations of free fatty acids were significantly increased and the use of carbohydrates as a burned fuel decreased with HCA ingestion demonstrating that short-term HCA ingestion increases fat oxidation in untrained men. Likewise a similar study7 was conducted in athletes who received 250 mg of HCA or placebo for five days and then performed cycle ergometer exercise until exhaustion. At least two days later the same experiment was performed but those who had previously received the HCA now received the placebo and vice-versa. The results showed that HCA increased the amount of fat burned as a fuel while significantly decreasing the amount of carbohydrate burned as a fuel during exercise (p 0.05). Colchicine has no effect on uric acid levels rather it stops the inflammatory process by basically poisoning white blood cells and preventing their movement into areas of inflammation. More than 75 percent of patients with gout show major improvement in symptoms within the first 12 hours after receiving colchicine. However up to 80 percent of patients are unable to tolerate an optimal dose because of gastrointestinal side effects which may precede or coincide with clinical improvement. Colchicine may also cause bone marrow depression hair loss liver damage depression seizures respiratory depression and even death. Other anti-inflammatory agents are also used in acute gout including various nonsteroidal anti-inflammatory drugs (NSAIDs) such as indomethacin phenylbutazone naproxen and fenoprofen. Once the acute episode has resolved drugs like allopurinol or febuxostat (Uloric) to keep uric acid levels within a normal range. These drugs are also associated with side effects and do not address the underlying cause. In the acute attack colchicine may be necessary to prevent excessive joint destruction.
