Schneiderman the company explained the decision at a Summit I attended in November held by the United Natural Products Alliance. Jim Sander senior vice president and chief legal officer and Guru Ramanathan PhD senior vice president and chief innovation officer both with GNC discussed the company s settlement. According to Sander the company first received news of the AGs letter regarding the impure marketing of five products from a New York Times reporter on deadline. They received the call at 4 o clock and were given one hour to respond. Regarding the testing on finished goods Sander said We knew it was inappropriate right away. The company submitted to an information request. We gave them everything he said noting that the company supplied 70 000 pages of information. Ultimately the AGs findings were that GNCs products were consistent with GMPs (good manufacturing practices) and labeling laws. So why did they settle GNC said it agreed to a settlement because the alternative was tedious litigation and concerns regarding consumer confidence. The perception was that consumer protection laws are inadequate Sanders explained. A drawn-out investigation would keep these erroneous statements on people s mind. Under the agreement GNC will perform DNA barcoding on the active plant ingredients used in its products implement testing for contamination with allergens both before and after production and post prominent signage advising consumers of the processed chemical nature of extracts. GNC will implement these procedures in all of its more than 6 000 stores nationwide mak- I ing the agreement the first in the nation to require testing standards for herbal supplements that exceed current FDA (U.S. Food and Drug Administration) requirements. At the Summit Sander and Ramanathan expressed the company s desire for consumer safety and confidence and asked those in the natural products industry for a coordinated approach to elevate standards--including pre-market registration of products stricter raw material requirements and a media strategy. C East Brunswick NJ 08816 JanetP VRMmedia.com Industry Responds to Oregon AG Lawsuit Against GNC he natural products industry has responded to a lawsuit filed by Oregon Attorney General (AG) Ellen Rosenblum alleging that supplement retailer GNC (Pittsburgh PA) violated the state s Unlawful Trade Practices Act. The lawsuit accuses GNC of selling workout supplements containing picamilon a prescription drug used to treat neurological conditions. Acting Deputy Director of the Dietary Supplement Programs at the U.S. Food and Drug Administration (FDA) Cara Welch wrote in a signed affidavit on September 28 that picamilon does not fit any of the dietary ingredient categories under the law. Despite this assertion the FDA has yet to use its enforcement power to restrict the ingredient. Both the Natural Products Association (NPA) and GNC have responded to the lawsuit. NPA strongly criticized the FDA for its failure to take action in this case and for its decision to delegate authority to the state level. The FDA has both the authorities and tools in place to take action against harmful ingredients said Dan Fabricant PhD executive director and CEO of NPA. It is concerning to us that the T FDA is delegating its responsibilities to the states instead of using its own enforcement authority. If the FDA finds an ingredient to violate the law then it should take immediate administrative action not use taxpayer dollars to fund a state priority. The AG s lawsuit also accuses the retailer of selling BMPEA which the FDA did take action to remove from store shelves earlier this year. In the case of BMPEA the agency took the necessary steps to shield consumers against a product that it has found to contain an illegal adulterated dietary ingredient said Fabricant. NPA encourages this type of action in response to picamilon instead of delegating its regulatory and enforcement authority to states. On October 23 GNC filed a motion to remove to Federal Court the lawsuit filed against it by the Oregon AG. Regrettably despite our best efforts we were unable to reach an agreement with the Oregon attorney general said GNC in an issued statement. As a next step the company filed today to have the action moved to Federal court. Products sold by GNC are regulated by the U.S. Food and Drug Administration. GNC s vendors certify that they are in full compliance with the Food Drug and Cosmetic Act (FDC Act) and to guarantee that their products meet all applicable Federal and state laws. Consistent with retail standard practice GNC has appropriately relied on the guarantees of suppliers that their products are lawful the statement continued. This is a basic tenet of retail sales and is recognized in federal law in the FDC Act and what is known nationally as the FDA Guarantee. GNC is contractually entitled to indemnification by its third-party vendors related to these guarantees and requires appropriate levels of third party vendor insurance. GNC was targeted by the New York AG in February along with three other retailers. Although the company was found to be compliant with GMPs they come to an agreement with the AG. Drug-spiked Supplement Maker Gets Prison Term T he United States Attorney s Office for the Middle District of Pennsylvania announced that Cheryl Floyd owner of Floyd Nutrition LLC is sentenced to 30 months in federal prison by United States District Court Judge Sylvia H. Rambo for introducing misbranded drugs into interstate commerce and money laundering. Rambo also ordered Floyd to pay 10 000 in fines and 7 530 in restitution. According to summaries presented to the court by Assistant U.S. Attorney Christy H. Fawcett in connection with the guilty plea and the sentencing hearing Floyd also known as Cheryl Floyd Brown was the owner and operator of an internet-based business known as Floyd Nutrition LLC based at her Harrisburg residence with warehouse facilities in the Harrisburg area. The items offered for sale between 2010 and 2014 were purported allnatural dietary supplements sold as weight loss products. They contained the drugs sibutramine and phenolphthalein which are not listed as ingredients in the product labels. As a result of the health risks the FDA (U.S. Food and Drug Administration) detained shipments of the products coming from China intended for Floyd s business. In July 2014 search warrants executed at locations used by Floyd s business resulted in seizure of a large quantity of the products. The products were sold over the internet by Floyd under names such as Slim Trim U ZXT Slim Bee Pollen Magic Slim ZXT Bee Pollen ZXT Gold Infinity Lean Body Extreme Bnew Beauty and Body and Natural Body Solutions. Manufacturing and selling products marketed as all-natural dietary supplements put U.S. consumers at risk of serious injury or death when they actually contain dangerous pharmaceutical ingredients said George M. Karavetsos director FDA Office of Criminal Investigations. We will continue working with our law enforcement partners to protect consumers from public health risks and fraud. The FDA s deputy director of CFSAN (Center for Food Safety and Applied Nutrition) then invited the company to meet with the agency. A delegation affiliated with Jarrow Formulas Inc. (JFI) and led by Jarrow L. Rogovin had a meeting with five officials from the FDA at CFSAN headquarters in September. According to the company the meeting concerned issues of importance to the dietary supplement industry probiotics and in particular how this category will be handled by the Revised NDA Draft Guidance (now in progress) J the recent revisions to California s Proposition 65 and its impact on supplements and the need for the FDA to be more forceful in publicizing enforcement actions against bad players who misrepresent their illegal products as dietary supplements. In addition to the high-profile developments in areas such as lactose- dairy- and gluten-free foods and drinks there has been an increase in interest in GMO (genetically modified organism)free or non-GMO products. In terms of product activity launches featuring GMO-free claims and labeling remain relatively limited on a global scale the company said. More than 13 percent of launches recorded by Innova Market Insights in the twelve months to the end of June 2015 were marketed on an additivefree of preservative-free platform while 7.8 percent were marketed as organic and 6.3 percent as natural. At the same time just 4 percent used GMO-free labeling although this was a significant rise year-on-year driven mainly by rising levels of interest in the U.S. Over the 12-month period the U.S. accounted for 43 percent of global launches using GMO-free claims moving ahead of the E.U. on 39 percent despite the much larger number of countries involved in the latter region. Now a team led by a researcher at the University at Buffalo (UB) has discovered that vitamin D may play a significant role in eye health specifically in the possible prevention of age-related macular (AMD) among women who are more genetically prone to developing the sightdamaging disease. In a paper published in JAMA Ophthalmology online Amy Millen associate professor of epidemiology and environmental health in UB s School of Public Health and Health Professions and her team found that women who are deficient in vitamin D and have a specific high-risk genotype are 6.7 times more likely to develop AMD than women with sufficient vitamin D status and no high risk genotype. Researchers analyzed data compiled on 1 230 women ages 54 to 74 that participated in the Carotenoids in Agerelated Eye Disease Study (CAREDS) which is an ancillary study of the Women s Health Initiative (WHI) Observational Study (OS). The WHI OS is a major National Institutes of Healthfunded research program aimed at addressing the most common causes of V death disability and poor quality of life in postmenopausal women. UB is one of 40 WHI centers nationally. CAREDS was conducted among participants at three of the centers University of Wisconsin (Madison) the University of Iowa (Iowa City IA) and the Kaiser Center for Health Research (Portland OR). Researchers were able to determine participants vitamin D status by analyzing serum samples for a vitamin D biomarker 25-hydroxyvitamin D [25(OH)D] which provided a glimpse into vitamin D intake through all sources diet supplements and sunlight. Human skin can synthesize vitamin D when exposed to ultraviolet light Millen explained. However for many people 15 to 30 minutes a day with 10 percent of their skin exposed might be sufficient. In one double-blind study of 116 patients with type 2 diabetes berberine at a dosage of 500 mg twice a day lowered fasting blood sugar from just above the range of being classified as diabetes (i.e. 126 mg dL) to normal blood sugar levels (less than 100 mg dL) in most subjects. The same sort of comparative results seen in type 2 diabetes were found in the treatment of elevated blood lipids (cholesterol and triglycerides) and high blood pressure. Studies also supported that berberine combined with conventional drugs in these conditions is safe and can produce better results than the drugs used alone. Side effects with berberine occurred at much lower rates and were milder than prescription drugs. Side effects were seen mainly at higher dosages (e.g. 500 mg three times a day) and included such as nausea diarrhea constipation abdominal distension and abdominal pain. In regard to its effects on blood lipids not only does it lower total and LDL cholesterol unlike statins berberine also lowers blood triglycerides and raises beneficial HDL cholesterol. Berberine has also been shown to lower apolipoprotein B by 13-15 percent which is a very important risk factor to reduce. It addition to enhancing AMPk berberine works by inhibiting an enzyme called PCSK9 leading to more LDL being removed from the bloodstream. The typical dosage for berberine in these studies was also 500 mg two to three times daily. The researchers conducting the metaanalysis concluded that berberine has comparable therapeutic effect on type 2 diabetes elevated blood lipids and hypertension with no serious side effect or toxicity. Additional research has shown that as little as 6.3 grams day dark chocolate (providing 30 mg of polyphenols) also decreased systolic blood pressure by 2.9 mmHg and diastolic blood pressure by 1.9 mmHg in patients with prehypertension or mild hypertension.4 Another study5 found that that consuming 100 grams day of cocoa (containing 500 mg of polyphenols) modestly reduce systolic and diastolic blood pressure in elderly patients with isolated systolic hypertension. At the end of the 14-day study systolic BP had declined by 5.1 mmHg and diastolic BP declined by by 1.8 mmHg.6 Now if this isn t a good enough excuse for eating chocolate I don t know what is. Potassium Potassium is a vital mineral that is necessary to help maintain normal osmotic pressure of body fluids and the acidbase balance of the body. It also functions in the transmission of nerve impulses and muscle contraction. Taking potassium orally seems to reduce systolic blood pressure by about 2-4 mm Hg and diastolic blood pressure by about 0.5-3.5 mm Hg.7 Potassium seems to be most effective for people with low potassium levels high daily sodium intake and for African Americans.8-10 Consuming potassium from dietary sources also seems to decrease the risk of developing hypertension. Foods that provide at least 350 mg of potassium per serving and that are low in sodium saturated fat and cholesterol might help reduce the risk of developing high blood pressure.11 12 Likewise consuming potassium from dietary sources seems to decrease the risk of stroke. There is some evidence that foods providing at least 350 mg of potassium per serving and that are low in sodium saturated fat and cholesterol might help reduce the risk of stroke.13 14 trial 17 86 participants ranging from 20 to 80 years of age with an initial untreated systolic blood pressure of 130 to 159 mmHg received nattokinase (2 000 FU capsule) or a placebo capsule for eight weeks. The objective of this study was to examine the effects of nattokinase supplementation on blood pressure in subjects with pre-hypertension or stage one hypertension. Seventy-three subjects completed the protocol. Compared with the control group the statistically significant changes in SBP and diastolic blood pressure were -5.55 mmHg and -2.84 mmHg respectively after the eight-week intervention. The corresponding net change in renin activity was -1.17 ng mL h for the nattokinase group compared with the control group. In conclusion nattokinase supplementation resulted in a reduction in systolic and diastolic blood pressure. These findings suggest that increased intake of nattokinase may play an important role in preventing and treating hypertension. was undertaken to clarify the mechanism of the antihypertensive effect of 100 mg day coenzyme Q10 (CoQ10) in hypertensive patients. At the end of the treatment systolic blood pressure decreased from 164.5 to 146.7 mmHg and diastolic blood pressure decreased from 98.1 to 86.1 mmHg. Plasma CoQ10 values increased from 0.64 0.1 microgram ml to 1.61 - 0.3 micrograms ml. In addition serum total cholesterol decreased from 222.9 mg dl to 213.3 mg dl and serum HDL cholesterol (the good cholesterol ) increased from 41.1 to 43.1 - 1.5 mg dl. The researchers also found that the antihypertensive effect of CoQ10 is probably based on its ability to reduce peripheral resistance. Peripheral resistance is the resistance of the arteries to blood flow. As the arteries constrict the resistance increases and as they dilate resistance decreases. Conclusion Chocolate cocoa potassium nattokinase and coenzyme Q10 are not the only nutraceuticals with value for lowering blood pressure but supplementation with one or more of these is a good place to start for individuals with mild-to-moderate hypertension. However supplementation is only one spoke on the wheel of hypertension treatment with the other spokes including diet exercise and stress control. As harmful as some of these stresses can be internally generated stress or relationship stress what one might call personal stress can be the worst and most damaging because it can be unrelenting. My top tips for reducing stress then as a clinician and research scientist are these (in the order of importance) 1. Gratitude and mindfulness--I tell my son (and frequently myself) gratitude not attitude. It s much harder to feel stressed when we remember to give thanks for all the positive things rather than focus on the negatives. 2. Healthy habits--it s much easier to deal with stress when we feel healthy and have mental physical and spiritual vitality. The primary stress-relieving healthy habits Deep and refreshing sleep. Getting to bed early and good sleep hygiene can heal much. Aerobic exercise daily. Walk more sit less. Eat simple whole food and some raw foods. As much as possible avoid refined sugar in any food or drink keep moderate stimulant use like tea and coffee to the morning hours only. Stretching walking meditation time in nature wild spots. Vacations. Just remember on vacations we don t work Equanimity. A feeling that all is well all is ok all is as it should be. We are not in control anyway so it s best to just go with the flow. That doesn t mean we are helpless and take no responsibility in our lives. How does your health and wellness routine change during the holidays I m more likely to feel a little sad during this time of year because of lost loved ones and my younger years celebrating Christmas with them. This is also a dark cold time of year for many so Yule time cheer and the holiday atmosphere and celebrations are a way of dispelling the dark and bringing families and friends together. I take winter wellness herbs almost daily like elderberry andrographis and respiratory formulas. I make a lot of herbal teas with wellness herbs like lemon balm cedar leaf tea garden sage thyme oregano teas or ginger and licorice or even American ginseng for strength and energy. I take vitamin D because research shows that we are more likely to be deficient in this important immune nutrient in the winter months. I take omega-3s a daily organic men s multivitamin with B vitamins vitamin C and other nutrients. Finally I get out in the cold and walk and move my body as much as possible and really focus on getting regular sleep all for maintaining a strong immune system.
